Appraisal Clause "Value Dispute" Specialists
In instances where an insured and their insurer cannot agree on the amount payable for a property claim, either party may submit a written request to resolve the dispute through the Appraisal Clause - also known as the "Right to Appraisal" within an auto policy.
The purpose of the appraisal clause is to establish an official process for determining the amount of damage resulting from a loss. In general, appraisal provides for the following:
- Either party may demand that the loss and value dispute be submitted to appraisal.
- Appraisal demands must be made in writing.
- The appraisers then agree on a third party to act as an umpire.
- If the appraisers fail to agree on the umpire within 14 days, a court or in some cases the state insurance commissioner will appoint the umpire.
- The appraisers attempt to agree on the amount of the loss and value.
- If the appraisers fail to agree, their differences are submitted to the umpire.
- An award in writing is required and considered Final when at least two parties to the appraisal are signatories.
- Each party covers its appraiser's fee. while the umpire and other appraisal costs are split equally.
